Asking someone in another country to buy Sailfish X for me? [answered]

I live in the US and I really, really, really wanna use Sailfish OS. Since I can't buy it myself, I'm thinking about asking one of my grandma's friends in the UK to buy it on my behalf. (People in the UK can buy it, right? I used a proxy website that says I'm in the UK to check, and it looks like they can buy it.) But I just want to know how exactly that will work. It's okay to do this, right? Will they have to use my Jolla account to buy it, or should they create their own account? Can they just download the image and email it to me, or what?

EDIT: Okay, since this apparently isn't obvious to anyone else, I guess I'll have to explain it so people will see it BEFORE answering or commenting. I am perfectly aware that I can use a VPN to trick the website into thinking that I'm in an authorized country. HOWEVER, that might still count as purchasing it from an unauthorized country, which violates the terms of service. If I violate the terms of service, my license to use the service will be terminated. And there's no guarantee that I'll be able to reinstall Android and restore full functionality to the phone, so that's $300 down the drain. I don't even have a job right now, and when I get a job, I'll probably be on minimum wage. I can't afford to take that risk. Asking someone in another country to buy it for me is a lot less risky.

EDIT 2: So nobody understands my question except for the person who commented instead of answering? My question has nothing to do with using a VPN. I'm asking how asking someone in another country to buy it for me to be on the safe side would work. Why is nobody willing to answer that question?

EDIT 3: I GIVE UP! NOBODY understands my question! Nobody has even BEGUN to answer it! (Except Sthocs, who decided to comment instead of answering.) My question has nothing to do with whether I should use a VPN or ask someone from another country to buy Sailfish X for me! When I asked this question, I had decided to ask someone from another country to buy Sailfish X for me. I didn't want to know about other options. I already know about them. I just wanted to know exactly what I should do when having someone else buy it for me! I wish I could close this question because I'm just getting more and more frustrated, but apparently I have to have a reputation of 25 before I can do that. Can someone close this for me so I don't start crying again later?

Yes they will have to use your Jolla account to buy it, because that's with your account that Jolla will verify if you can download the proprietary stuff (Text prediction, Exchange, Android)

Melody, we're not lawyers here (I guess.. I'm not, at least). We do not know if there is a legal difference of using a VPN to buy Sailfish or asking someone in another country to buy it for you. Maybe both is fine, maybe both isn't. Maybe one of it is fine, but the other isn't. Does the terms of use say anything about giving control of your account so someone else? Are we even allowed to use our phones in the US or only in authorized coutries? Maybe having someone buy it as their own phone and lend it to you would be the most straight forward way, in legal terms, but I'm not sure about that. Is it allowed to sell an XperiaX with Sailfish installed, e.g., to a friend? Does the buyer has to live in an authorized country? Maybe you don't get an official answer because they're just fine with what you do as long as you don't tell them / ask for permission....

As I understand Jolla's terms of service the only probably legal way for you to use the phone with full SailfishX is that a resident of the eligible countries buys the phone and installs the OS with additional features which are payed, and then you use the phone with his Jolla account. From the answers in the Jolla blog I understood that the selling of the phone is permitted and the license transfer to the other Jolla account is possible, but this transfer is possible I guess only for the resident of country within the sales range, but not outside it.

Probably you can ask in the Jolla blog. If you physically visiting Europe and here buy Xperia X with already installed full SailfishX, will the transfer of the license be possible to the Jolla acount of a person residing in the USA.

_Using the Services outside of the Authorized Countries, or in violation of any export control law or regulation is prohibited_ - this is a tricky point. Will I be legally able to use my SailfishX phone during the travel outside of the authorized countries? I am the resident of of EU.

jolla does not block vpns from purchasing or downloading. I for example am in the us in boston and bought it through a free vpn in germany. No problem downloading it either.

In terms of emailing the image, the image is rather large and likely will not easy to email. If they download the image and are going to give it to you, you would likely need to have them place it in some shareable drive, nextcloud, dropbox, or google drive.

The reason many of us are suggesting alternatives is because it seems the method of having someone else download it raises other security concerns that many of us would not advise to take. In the end it is your decision. Weigh the differences.

A VPN in Germany for the sake of this exercise means I purchased in when I was "in" Germany, which is fine by them. What are your concerns if you take the approach I mention?

Well, you're not ACTUALLY in Germany. If using a VPN counts as being in an authorized country, why would they even need to say that you have to be in an authorized country when you go to the page to buy Sailfish X? You can't even access that page if you're not either actually in an authorized country or using a VPN to make it think you're in an authorized country. I'll just email Jolla about it. I can't afford to get a new phone right now anyway because I don't have a job. I'm sure I'll get a response by the time it's actually possible for me to get a new phone.

melody use nordvpn. its supet easy but will cost you. worth its like 80$ for two years. choose uk server.

Uh, I use Opera. Not being capable of using a VPN isn't the issue and it's kind of shocking that nobody can understand that. I'm afraid to just use a VPN because buying Sailfish X from an unauthorized country is prohibited. I would be violating the terms of service, and if I violate the terms of service, my license to use the service will be terminated. And there's no guarantee that I'll be able to reinstall Android and return the phone to its full functionality, so that's $300 down the drain. Tricking the website into thinking I'm in an authorized country may still count as purchasing it from an unauthorized country. I'm not risking it.

@melody5697 I am not sure how to settle your concern. The US market is not part of their plan yet, they have taken an approach to build up a user base in the BRICs and starting in some places in Latin America. Doing the US market without a plan is bad and led to much of the demise to even when Nokia was bringing the N900 out. If it is done wrong it is the end or darn close to it. So there are reasons that I even agree with holding off on the US market. That being said, doing the VPN satisfies the terms of service cause the purchase is then done in a country they have a purchase plan in, in a VPN as @rfa mentions means that is where the computer is at the moment of purchase. You maybe physically outside of the country but you are within the terms since Jolla is not going to go through and trace through likely encrypted data to do the forensics of figuring out where you actually were at the time. I know that is not an official statement from Jolla but that is cause it is protecting them. You can try the route of going through some one physically there and that would be fine too, but raising this concern about the VPN is unnecessary as many of us have already done it and remain to keep our license. I hope that helps

I bought Sailfish X from Paraguay trough VPN using Opera, no problems at all... Then flashed again Android and restored my TA backup, and phone is like it was never unlocked, so won't be any risk if you search how to backup TA, flash Android, Sailfish X, etc. Waiting Sailfish X to be more stable for me and bugless to return to Sailfish X :)
