A warning to all of us who want to buy or sell our Xperia X's Received this from Jollacare:

If i want to upgrade to a new phone or in the future get a gemini PDA, will i have to buy another license? That is not acceptable in nowadays. Moving the license is simple and easy for you guys. Thanks for your message! Yes, there are always exceptions to the policy. If it is stolen or broken, you need to replace with a similar device, e.g. Xperia X -> Xperia X.

The license is per device, so you cannot transfer it later from e.g. Xperia X to Gemini PDA, unfortunately. Sincerely, Jolla Customer Care

  2. If I buy a used Xperia X device with Sailfish X already installed, can I use it with my own Jolla Account? You can use the device with Sailfish OS, but without the licensed content. If you want to have the full experience you need to purchase a new license.

IMHO it is. Everything mentioned within this question is referred to by FAQ from Jolla, so there is nothing informative about that question and for me it is 'subjective' to state, that this worth an alert. But nevermind. Leave it open.

That may be, but I would also like to find out whether the conditions mentioned in Jolla's FAQ are actually legal in the EU, as per @Giacomo Di Giacomo's comment.

This is pretty current thing as for me. I'll may have to transfer my Xperia X licence to the same phone but the IMEI has changed. These are quite problematic questions and as we can see from the answers it can also require knowledge of laws.

@Sakke But as you can read in the FAQ your case is covered and no problem at all. Just contact Jolla and they will help you transfer your licence to the new phone (i.e. new IMEI).

This policy is against EU rules. You can always resell non-OEM licenses in the EU. See here. Jolla should modify their license policy to comply with EU rules and allow license transfer from one person to another.

According to that article, and if i'm reading it right, you can't resell Sailfish X license but you can sell Xperia X with license on it as a single item?!?!

No, it's not an OEM license so you can resell the license separately. If you consider it as an OEM license, and I'm pretty sure you cannot since you purchase the SFOS license separately, then this would be the case.

This policy imho is not bad at all and just for the record, Jolla has a positive image for me!

Why should Jolla need to manually transfer your license without being compensated for it? It's much work/hassle. What good is a 'supporter' if he/she is not willing to provide Jolla with the means to develop Sailfish?

From the FAQ:

  1. Why do you charge 49.90€ for it? With the price you get a fully supported commercial version of Sailfish OS that includes commercial components like Android Runtime, and Exchange support. You also get support and updates for your OS from Jolla, and you can support the Sailfish OS development. Jolla has invested a lot time and money for the development of Sailfish OS. Supporting a release officially is also a significant cost and there are licensing costs that Jolla needs to cover when distributing commercial components of Sailfish OS.
  2. Can I move my Sailfish X from my old Xperia X to a new device or do I need to purchase a new license? The Sailfish X license you’ve bought is meant for one device model, i.e. if you upgrade your hardware to e.g. XA2 in the future you need to purchase a new license. However, if your Xperia X gets broken or is stolen and you want to transfer your license to another Xperia X device (F5121 or F5122) we will transfer it for you.

I'm sorry, I'm a bit annoyed by this (your) petty complaint. Try out without commitment and if it doesn't please offload the hassle, i.e. the transfer work to others? This is really not what I'd call a 'supporter' (no wonder ad-supported 'free' Android flourishes...).

That is your opinion. Me and other users have the right to have our opinion. The main issue here is that they changed their policy. I am very annoyed and it's not a petty complaint. We all have rights to complaint. If you don't agree you have that right

@deutch1976: I see that you are annoyed and I respect your opinion. I just don't see how Jolla could 'for free' transfer a potentially high number of licenses? What I really don't like is to read about 'supporter' and then - imho - not give support at all. -- If they changed the policies after you bought the license I would suppose that Jolla is bound to the original conditions. Did they state that they will freely transfer the license to other users? @nthn: IMNAL and I'm a bit careful to believe the website (link) given by Giacomo. There might be many 'finer details'. EU tends to be complicated.

@chappi, i like Jolla and if i didn't i would not achieve a license. As i said before, the main reason i started this topic was to avoid bad surprises for those who are trying to sell or buy Xperias. As the title says it is a Alert ;)

Please note: there is no problem with buying an Xperia X with Sailfish from another user and using it as your own device without any compromise - even if the license might not be transferred - because the Xperia stays fully operable and you can use your Jolla account with any Xperia X you have regardless who originally bought the license. There might be only one catch: from Jolla's response it appears that if your Xperia breaks the Sailfish OS installed on the broken Xperia X can only be transferred to a new device by the owner of the license, i.e. the former owner of the Xperia X.

EDIT: what I once wrote DOES NOT APPLY ANYMORE. Jolla has changed the policy since which means that you might not be able to update SFOS on a phone that you have bought from another user

I'm sorry but I have to contradict you. * It is safely possible to transfer the license to another Xperia X. I did it at least 3 times before. * As we know the license is certainly linked to both the IMEI and the account that purchased it. Of course, you need to kindly contact the Zendesk Jolla support, trying to put the question in a positive way, to help the operator: solve a problem, do not create a problem.

The steps are these: before selling your phone, format the data and delete the Jolla account from the device. Then once in possession of the new Xperia X, log in with your account, then go to jolla.zendesk and ask for a simple update of IMEI. One - two days busy and the process is completed. It is in your rights because you bought a software a license (that should be linked only to account, ndr)

If you want to sell the Android license along with the phone, know that is more "border line": either the customer inherits your account, or he buy a new license under its account. Period.

In practice: you can transfer IMEI but not account property.

Hello Sailors! following the last two annoncements i saw on this forum: https://together.jolla.com/question/226346/for-sale-sony-xperia-xa2-black-h3113-sailfish-license/ and https://together.jolla.com/question/223604/for-sale-sony-xperia-xa2-dual-sim-model/I would like to warn and restate: as a reference point for selling a phone on the website, as per item 2 of the software's Notices & Disclaimers: "The Sailfish X license is tied to (i) the Jolla account that is used to obtain the license, and (ii) the IMEI code of the device on which the software is first installed. Jolla will not support the transfer of the license from one user account to another, or from one device model to another."So in short, please DO NOT ADVERTISE SELLING A PHONE WITH ''PAID LICENCE INCLUDED'' CAUSE THAT IS EITHER A MISCONCEPTION OR A TRICK! You can sell a Salifish phone and thats great. But the client will be responsable to purchase his/her licence him/herself Thank you☺.

Good point! And please keep in mind that this restrictive approach is the only way Jolla can justify to stay in the consumer business (at least a bit). Jolla needs to sell at least some licences

@AkiBerlin Apparently they don't want to sell licenses very much: They (actively) restrict sales to EU - excluding 90% of the world and the 3 largest smartphone markets. Not my definition of hungry for sales...

I think there could be one workaround for this issue.

Before buying a license, create a new email address just for this purpose, take care to keep the signup details fairly anonymous. Then create a new Jolla account using the same email address, and then purchase the license through this account.

Later, should you wish to sell your device, you provide the buyer with the credentials for this email account and the Jolla account. Take care to replace your user details for the Jolla account with random data before passing them on to the buyer, and ask them to update the account with their details.

wrong marketing policy I can not buy another license if I change the phone 50 euros are not few.My xperia x and broken I do not want to buy it yet. If you can transfer the license on xa2 ultra ok. or I contributed to the cause but only once

The license is for the Xperia X not the XA2. XA2 needs a different integration work and this work needs to be paid if you want to use the proprietary parts and bits.

with android support the apps work badly.. I remember whatsapp in video call was horrible. 12 months of support? After new update the system you still have to pay again? I do not agree.

@Comax1970 I've purchased my Sailfish X license on day one (September 2017). I never had to pay more, however my Xperia still continues to receive updates.

Totally agree with author! This is a bad marketing policy. If old phone has been broken then you'r license is lost, because you can't shop old model and can't move license on modern phone.
